Mel Gibson was telling the truth after all. Police won’t charge the actor-director for battery charges since there was no evidence that Gibson actually attacked a reveler at an LA nightclub.

Mel Gibson and his pregnant girlfriend Oksana Grigorieva made a rare appearance at the launch of Playhouse on Wednesday. The couple, who sat in a VIP section, seemed to enjoy themselves until a magazine reporter who posed as a fan took pictures of them. Gibson’s security guards were quick to take action, confiscating the camera and deleting the photos, but the relentless reporter just don’t know how to quit. He called for backup and sent a male friend to get another shot.

The ugly part came when the unidentified man filed a report against Gibson, alleging that the actor flew into a rage and attacked the man, tearing the man’s shirt, before leaving the nightclub.

Unfortunately for the said man, police have found no evidence of battery since witnesses have claimed Gibson was not even near the alleged victim since the guards already took the two reporters away from Gibson’s table.

Fortunately for Mel Gibson, he won’t be dealing with any more drama before his first child with Oksana Grigorieva comes sometime in the fall.
