Los Angeles, Calif.-Chris Brown lost his bid to delay the preliminary hearing for his assault case wherein his lawyer argued to wait for a related California Supreme Court decision.

Mark Geragos, Brown’s attorney, filed a motion for appeal this month requesting to delay the R&B star’s preliminary hearing which is scheduled on June 22. Court records reveal that the appeal was rejected Tuesday with no reason stated.

Geragos’ request to access police records which he argued to be crucial to the hearing was also rejected. In his appeal, Geragos said that a state Supreme Court case currently under consideration may affect his client’s access to the records and he wants a delay on those grounds.

Chris Brown may be subjected to “the expense and degradation of two preliminary hearings” if they get access to the certain police files after the preliminary hearing, Geragos said in his argument.

Brown is charged with assault due to beating then-girlfriend Rihanna at a pre-Grammy party in February this year.

Rihanna could stand witness during the preliminary hearing.
